2.5.2
Annexure A
p. 20
If consent
If consent has been obtained from all of the Credit Providers involved, the DC should apply for a Consent Order.
NDRC Practice NoteLast reviewed 2026-04
What this means in practice
A consent order is the fastest route: all credit providers agree, the magistrate confirms the rearrangement on the papers, and the order takes effect on grant. Hearing time is minimal and creditor opposition risk is removed.
Legal context
Statutory basis: NCA s 86(8)(a) read with s 87(1)(b). The order made under s 87 is what makes the rearrangement legally binding.
