    Form 17.2 — Proposal Submission

      Form 17.2 accompanies the debt re-arrangement proposal once the debt counsellor has completed the affordability assessment and developed the restructuring plan. It is sent to every credit provider whose debt is included in the proposal and to the National Credit Regulator.

      Form 17.2 confirms the over-indebtedness finding, summarises the consumer's income, expenses and total monthly affordability, and lists each credit agreement with the proposed instalment, interest rate and term. Annexure A clause 2.3.10 requires it to be sent within the prescribed timeframe after the credit provider responses to Form 17.1 have been received.

      Header block: Reference Number, Date Printed, document title 'Debt Restructuring Proposal'.

      Debt Counsellor block: DC Name, NCR DC Number, Postal Address, Telephone, Fax, Email.

      Consumer block: Full Name, ID Number, Juristic person registration number, Residential Address, Postal Address, Telephone, Email.

      PDA block: PDA Name, PDA NCR Registration Number.

      Affordability summary: Total Debt, Total Monthly Commitment, Affordability after DC and PDA fees, Over-indebtedness percentage, Rule set used to calculate the proposal.

      Distribution timing: Estimated date of first distribution to credit providers, Estimated delay in credit provider distributions due to upfront fee recovery, First Collection Instalment Date, Method of Payment (debit order / EFT / cash).

      Per-agreement table, one row per credit agreement: Credit Provider name, Account Number, NCA Account Type Code, Debt Restructuring Account Type Code, Account Description, Linked Insurance description, Goods Description (for Vehicle and Asset Finance), Inception Date, Original Expiry Date, Original Repayment Term, Outstanding Balance (incl. balloon and arrears, excl. future interest), Credit Limit (for credit cards / current accounts), Gross Monthly Instalment (incl. capital, interest, fees and insurance), Monthly service fees, Annual service fees, Source of balance, Date of balance, Contractual Interest Rate (per annum), Original Repayment Term remaining, Expired Term, Proposed annual fixed interest rate, Proposed extended term in months, Proposed opening balance after fee recoveries, Proposed monthly service fees (excl. transactional fees), Proposed payment obligation (excl. fees), Included or Excluded from Debt Review (with reason code if excluded), Bank Name (where the credit provider is not itself a bank).

      Closing block: Electronic signature of the debt counsellor, date of submission, distribution list (every credit provider plus NCR).

    What this means in practice

    Form 17.2 accompanies the proposal to credit providers and notifies them of the rearrangement terms. It is the document that opens the negotiation window before court application.

    Where it goes wrong

    Submitting Form 17.2 without the supporting affordability schedule is the most common error. The credit provider cannot evaluate the proposal without the underlying numbers, so they default to rejection.

    How credit providers typically respond

    Most credit providers respond to Form 17.2 within thirty days, either accepting, rejecting, or proposing amendments. Silence beyond thirty days is itself a position we can rely on when proceeding to court.
