    Can creditors take legal action after my debt review is terminated?

    Yes. Section 88(3) of the NCA only protects you from enforcement while you are under debt review. Once the debt review is terminated, creditors are entitled to demand payment of any arrears and to revert to the original contractual instalment.

    This is why the court application must demonstrate that you can afford the original repayment terms. In practice, most creditors accept a negotiated payment arrangement once you exit debt review, provided arrears are addressed.
