    After Removal

Can I renegotiate the terms of remaining debt with creditors after exiting debt review?

    Exiting Debt Review?

TITLE: Renegotiating Debt After Debt Review Removal | NDRC South Africa | META: Yes. After debt review removal you can negotiate directly with creditors. Many creditors will agree to new payment terms rather than pursue legal action.

Yes. Exiting debt review through the proper legal process restores your right to negotiate directly with creditors. While under debt review, creditors are legally bound to deal with you through your debt counsellor and the NCR-supervised restructuring process. Once debt review is terminated, that restriction falls away.

What creditors typically agree to negotiate:

    • New monthly payment amounts. If your income cannot immediately meet the original contractual amount, many creditors agree to a temporary arrangement.

    • Settlement discounts. On old accounts or accounts close to prescription, creditors sometimes accept a reduced lump-sum settlement.

    • Extended payment periods. Creditors may agree to extend the repayment period to reduce the monthly obligation.

    • Interest rate adjustments. Some creditors agree to freeze or reduce interest rates to facilitate repayment.

    Points to know before negotiating:

    • Get every agreement in writing before making any payment. A verbal agreement with a call centre agent is not legally binding.

    • A full and final settlement agreement must be confirmed in writing by the creditor's authorised representative before you pay the settlement amount.

    • If a creditor issues summons immediately after removal before negotiations can occur, you may need legal assistance to respond to the summons and negotiate simultaneously.

    • NDRC can assist with creditor negotiation post-removal as part of our financial rehabilitation support.

Not all creditors will negotiate. Some insist on immediate full payment or proceed to legal action. Understanding this risk before applying for removal is part of what NDRC's free assessment covers.
