1. Acceptance of Terms
By accessing, using, or engaging with the services provided by The National Debt Review Center Pty Ltd (Registration Number: 2014/286439/07), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and NDRC.
2. Definitions
"NDRC", "we", "us", "our" means The National Debt Review Center Pty Ltd.
"Client", "you", "your" means the individual or entity engaging our services.
"Services" means all debt counselling, debt review, financial consultation, and related services provided by NDRC.
"NCA" means the National Credit Act 34 of 2005.
"NCR" means the National Credit Regulator.
3. Services Provided
NDRC is a registered debt counselling practice (NCR Registration: NCRDC3106) providing services in accordance with the National Credit Act 34 of 2005. Our services include but are not limited to:
- Debt review assessments and applications
- Debt counselling services
- Debt review removal and clearance certificate applications
- Financial consultation and advice
- Reckless lending investigations
- Home and vehicle repossession prevention assistance
- Credit rehabilitation services
4. Client Obligations and Responsibilities
As a client of NDRC, you agree to:
- Provide complete, accurate, and truthful information regarding your financial circumstances, debts, income, and expenses
- Submit all required documentation in a timely manner
- Comply with payment arrangements as agreed in your service agreement
- Notify NDRC immediately of any changes to your financial circumstances, contact details, or employment status
- Cooperate fully with the debt review process and follow recommendations provided
- Refrain from taking on additional credit without prior consultation and approval
- Attend meetings and respond to communications in a timely manner
- Comply with all applicable laws and regulations
5. Fees and Payment Terms
Our fees are regulated by the National Credit Regulator and comply with the fee structure outlined in the National Credit Act. Fee arrangements include:
- All fees will be clearly disclosed and agreed upon before services commence
- Consultation fees are payable at the time of service
- Debt review fees are regulated and collected as per NCR guidelines
- Payment terms will be specified in your individual service agreement
- No hidden or additional fees will be charged without prior written agreement
- Refund policies are governed by applicable consumer protection laws
6. Service Limitations and Disclaimers
While NDRC is committed to providing professional services, certain limitations apply:
- We cannot guarantee specific outcomes or results from debt review or other services
- Success depends on various factors including client cooperation, creditor acceptance, and court approval
- We are not responsible for delays caused by third parties, courts, or regulatory bodies
- Our services are subject to acceptance by creditors and approval by relevant authorities
- Economic and legal changes may affect service delivery and outcomes
7. Confidentiality and Privacy
NDRC maintains strict confidentiality of all client information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). We are committed to protecting your personal and financial information and will only disclose such information as required by law or with your explicit consent.
8. Limitation of Liability
To the maximum extent permitted by law:
- NDRC's liability is limited to the fees paid for services rendered
- We shall not be liable for indirect, consequential, or punitive damages
- We are not responsible for actions or decisions made by creditors, courts, or other third parties
- Client remains responsible for all debt obligations during and after the debt review process
- Force majeure events beyond our reasonable control may affect service delivery
9. Intellectual Property
All content, materials, software, and intellectual property provided by NDRC remain our exclusive property. Clients may not reproduce, distribute, or use such materials for commercial purposes without written permission.
10. Termination of Services
Either party may terminate services under the following conditions:
- Completion of agreed services
- Mutual agreement between parties
- Breach of terms by either party
- Non-payment of fees by client
- Failure to provide required information or cooperation
- Changes in legislation affecting service delivery
11. Governing Law and Jurisdiction
These Terms of Service are governed by South African law, including but not limited to the National Credit Act 34 of 2005, Consumer Protection Act 68 of 2008, and Protection of Personal Information Act 4 of 2013. Any disputes shall be subject to the jurisdiction of South African courts.
12. Complaints and Dispute Resolution
Should you have any complaints or disputes:

- We will investigate and respond within 10 business days
- Unresolved complaints may be escalated to the National Credit Regulator
- Alternative dispute resolution mechanisms may be utilized
13. Amendments to Terms
NDRC reserves the right to modify these Terms of Service at any time. Changes will be communicated to clients via email or website notification. Continued use of our services after such modifications constitutes acceptance of the revised terms.

15. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
