    How do I remove debt review status in South Africa?

    Removing debt review status in South Africa requires following one of three legally recognised processes under the National Credit Act 34 of 2005. There is no shortcut. Any service claiming to remove it instantly or without following these processes is a scam.

    Method 1: Clearance Certificate (Section 71) for consumers who have paid up all debts

    1. Confirm with each creditor that all accounts under your debt review plan are fully settled. Obtain paid-up letters.

    2. Instruct your debt counsellor to issue your Clearance Certificate (Form 19) within 7 days.

    3. Your debt counsellor updates the NCR Debt Help System and notifies all credit bureaus.

    4. Credit bureaus update your profile within 21 business days. The debt review flag is removed.

    Cost: from R450 excl. VAT with NDRC. Timeline: 1 to 3 weeks.

    Method 2: Court Application (Section 87) for consumers with outstanding debts but improved income

    1. Complete a free assessment with NDRC to confirm you qualify.

    2. Provide all required documents: ID, income proof, bank statements, previous debt counsellor documents.

    3. NDRC and admitted attorney partners draft the founding affidavit and court bundle.

    4. The application is served on all creditors at least 20 business days before the court date.

    5. Attorneys attend court on your behalf. The Magistrate grants the order if satisfied you are no longer over-indebted.

    6. NDRC updates the DHS and notifies all bureaus. Flag is removed within 21 business days.

    Cost: NDRC professional fees from R8,550 excl. VAT plus attorney and sheriff fees. Timeline: 4 to 6 months.

    Method 3: Rescission (Section 165) for consumers with an existing court or NCT consent order

    The process mirrors Method 2 but the grounds and legal test differ. An existing court or NCT order must be rescinded on specific grounds under Section 165. NDRC and attorney partners assess viability before proceeding.
