    Who qualifies for debt review removal?

    Which removal method applies to you depends on three factors: whether a court order exists for your debt review, whether you have settled your accounts, and whether your income allows you to resume original contractual payments.

    You qualify for a Clearance Certificate (Section 71) if:

    • All debts in your debt review plan are fully settled, OR

    • Only a home loan remains outstanding, it is not in arrears, and all other debts are settled.

    You qualify for a Court Application (Section 87) if:

    • You still have outstanding accounts but your income has increased since entering debt review.

    • You can show a Magistrate you are able to resume paying the original contractual monthly amounts.

    • No debt review court order has been granted, or a court order exists but you can demonstrate you are no longer over-indebted.

    You qualify for a Court Rescission (Section 165) if:

    • A debt review court order or NCT consent order was previously granted.

    • You can demonstrate you are no longer over-indebted, or all debts are settled.

    You do not currently qualify if you are still over-indebted, meaning you cannot afford to resume original contractual payments to creditors. A court application while still over-indebted will not succeed.
