Can I cancel my Debt Review and continue to pay directly the reduced installment to my creditors?

    to My Creditors?

TITLE: Can I Exit Debt Review and Keep Paying Reduced Instalments? | NDRC | META: No. Cancelling debt review means creditors can demand original contractual amounts. You cannot legally exit while continuing reduced payments without creditor consent.

No. When you exit debt review through a court order, creditors are no longer bound by the restructured repayment plan. They are legally entitled to revert to the original contractual amounts immediately.

The reduced payments under debt review exist because creditors agreed to accept them through negotiations by your debt counsellor, in exchange for the legal protection that debt review provides: assurance that you are making regular payments under an NCR-supervised plan. When debt review is cancelled by court order, that agreement falls away and creditors resume their original rights.

The court application must demonstrate you can afford the original contractual monthly amounts, not the reduced debt review amounts. The Magistrate only grants the removal order if satisfied you are genuinely not over-indebted and can meet the original obligations.

There is one exception: if individual creditors have separately agreed in writing to continue accepting reduced payments after debt review is cancelled, those specific creditors are bound by their written agreement. This must be agreed before the court application proceeds, not assumed.

If you cannot afford the original contractual amounts but want to exit debt review, the court application will not succeed. Remaining under debt review and working towards paying off the debts to qualify for a clearance certificate is the appropriate path in that scenario.

NDRC's free assessment includes an affordability analysis so you know before committing to a court application whether you meet the test.
