    What is a Section 129 notice vs letter of demand?

    These are different stages of the collection process with different implications:

    Section 129 Notice:

    • Formal legal notice required by the National Credit Act

    • Gives you 10 business days to remedy the default or apply for debt counselling

    • After 10 days, the creditor can proceed with legal action

    • The account may be excluded from debt review if you don't act within 10 days

    Letter of Demand:

    • Informal collection letter, often from attorneys

    • Precedes formal legal action

    • Indicates you may be over-indebted

    • You should consider debt review if you receive one
