    The impact on your spouse depends on your marriage regime:

    • Married in Community of Property: Both spouses MUST apply jointly for debt counselling. All assets and debts are considered joint.

    • Married with ANC (Ante-Nuptial Contract): Each spouse can apply independently, as assets and debts are separate.

    • Married with Accrual: Generally treated as separate estates, but consult with us for your specific situation.

    If your spouse is jointly liable on any credit agreements (e.g., both signed for a bond or vehicle), they will be affected regardless of the marriage regime.
