Both are legally binding orders that formalise your debt review, but they are obtained differently:
Consent Order:
• Obtained when all creditors agree to the proposed payment plan
• Submitted to the National Consumer Tribunal (NCT)
• Generally faster and less expensive
• Same legal protection as a court order
Court Order:
• Obtained through the Magistrate's Court
• Required when one or more creditors do not accept the proposal
• Takes longer but the court can overrule creditor objections
• Provides the same legal protection
Your debt counsellor will advise which route is appropriate for your situation.
