8 Common Debt Review Removal Scam Tactics
South African consumers seeking debt relief are increasingly targeted by sophisticated fraud operations. The National Credit Regulator has warned about companies charging up to R10,000 for fraudulent services that fail to deliver.
Promises of Instant Clearance
Claims of 'instant' debt review removal using legal jargon. True legal processes take time and follow court procedures.
Large Upfront Payment Demands
Requests for R10,000+ upfront before any services. Legitimate fees are transparent and reasonable.
Untraceable Operators
Business only via WhatsApp, no physical office, no CIPC registration. Legitimate businesses have traceable infrastructure.
No Written Contracts
Vague about fees, no invoices, suspicious addresses. Always insist on written agreements.
NDRC Impersonators
Criminals posing as NDRC representatives requesting payment into personal bank accounts.
'Free Removal' Bait-and-Switch
Misleading 'free' claims that result in hidden fees once you've shared personal information.
Fake Clearance Certificates
Fraudulent Form 19 documents that won't clear your status with credit bureaus or the NCR.
Fake Attorneys
Individuals claiming to be attorneys without Legal Practice Council (LPC) registration.
Official National Credit Regulator Warning
The National Credit Regulator (NCR) has issued multiple warnings to consumers against companies making false promises and violating the National Credit Act by:
- Charging illegal upfront fees without providing actual legal services
- Operating without registration as required by law
- Failing to deliver debt review removal after taking payment
- Advertising "free" removal services that incur major hidden costs
NCR Official Circulars: The NCR has published Circular 07 of 2025 and other alerts warning consumers about misrepresentation of debt review services.
How to Protect Yourself from Debt Review Scams
1. Check NCR Registration
Only NCR-registered debt counsellors can legally offer debt review services. Verify registration on the NCR website or use our debt counsellor search tool.
2. Verify Attorney LPC Registration

3. Insist on Written Disclosure
Legitimate service providers provide clear, written fee structures before you commit. Never accept verbal promises only.
4. Never Pay Large Upfront Fees
Be extremely wary of demands for substantial upfront payments for "guaranteed" removal without a clear, legally sound service agreement.
5. Verify CIPC Business Registration
Check if the company is a registered business via the Companies and Intellectual Property Commission (CIPC)
6. Search for Reviews & Verify Address
A lack of online presence or consistently bad reviews is a warning sign. Verify their physical office address – not just a PO Box.
How NDRC Legally Removes Debt Review
Exiting debt review is possible, but it must be done through established legal channels. We only use recognized legal processes under the National Credit Act:
Section 71 – Clearance Certificate (Form 19)
The most common way to exit debt review. Once you have paid off all restructured debts, your debt counsellor issues a Clearance Certificate (Form 19) and submits it to credit bureaus. Learn more about clearance certificates.
Section 87 – Court Application to Terminate
Applicable if there's no debt review court order and your financial circumstances have significantly improved. You demonstrate to a Magistrate's Court that you are no longer over-indebted. See fees and timelines.
Section 165 – Rescission of NCT Consent Order
If your debt review was made an order by the National Consumer Tribunal (NCT) and there was an error or mistake, an application can be made to vary or rescind that order.
