How do you prove reckless lending?
We understand that dealing with debt can be stressful, and encountering a potentially reckless credit agreement can make things even more confusing. At the National Debt Review Center (NDRC), we’re here to help you understand your rights and explore potential solutions.
If you believe a credit agreement might be reckless, here’s what you’ll generally need to show to prove it in South Africa
- You must demonstrate that your income at the time of the agreement was insufficient to cover the loan repayments along with your existing debts.
- If the lender didn’t conduct a proper affordability assessment before granting the loan, it strengthens your case. See Here Examples of Required Reckless Lending Supporting Documents
Important Point to Remember – It’s generally your responsibility to present evidence suggesting the agreement was reckless.
