Who qualifies for debt review removal?
All individuals in South Africa who meet the eligibility criteria outlined in the National Credit Act (NCA) qualify for debt review removal.
Here are the relevant sections of the NCA that deal with different aspects of debt review and its removal:
- Section 86(7)(a) of the NCA deals with debt review rejections. This section is invoked when a debt counsellor rejects an application for debt review because the consumer is not over-indebted.
- Section 71 of the NCA deals with debt review clearance certificates. This section is invoked when a consumer has paid off all the restructured debt under debt review.
- Section 87 of the NCA deals with the removal of debt review after you have been declared overindebted by a debt counsellor. This section is invoked when a court declares a consumer is no longer over-indebted.
- Section 165 of the NCA deals with the removal of debt review if there is a debt review court order in place. This section is invoked when a court order for debt review is in place, and the consumer wants to exit the debt review.
It’s important to note that if there are issues with your debt counsellor or if they’re no longer practicing, you may need to seek assistance from the NDRC, the NCR or another registered debt counsellor.
